I have been accused by two officers of driving whilst using a mobile handset. What actually happened was I had finished a call via my in car blue tooth and had the phone in my hand!! How do I stand??? Many thanks
If you were on bluetooth then you were using a “hand-held” mobile phone whilst driving and you have a defence.
If the officer’s simply say they saw you holding the phone rather than talking into it or having it up against your ear then you stand a good chance of casting a doubt on their account of events. If they say they saw you talking into the phone then they will probably gang up against you and it will be harder.
Have you got any points already? If you can prove you have got bluetooth then that may help to cast a doubt.
