An unmarked police vehicle saw me holding my phone in my right hand and said I was pushing the buttons and pulled me over. I did not use my phone to make/ receive and calls or text messages. I was very nervous and told the police officer that I took it out of my pocket and was moving it checking the time.
I wrote to Orange and they sent me a confirmation that no calls or texts were made but only the police or a solicitor could ask for the information if any calls were received.
That tends to be correct. They will normally only reveal the calls/texts received if we threaten to get a court order.
If you intend to contest this matter I will be happy to assist. You have to be using the phone for telecommunication purposes whilst driving. looking at the clock or simply holding the phone is not an offence.
