Speeding
I am a company car driver and received a NIP through my car leasing company. The offence was triggering a speed camera @ (47 in 40 limit). The NIP gave web site and pin to view photo evidence but all I get is a blank page. I sent NIP back unsigned with letter saying I was certain I was not driving.
I gave family names of those allowed and asked them to send photos of evidence. So far heard nothing since last week. I detest driving these days as I suffer repetitive strain and aches of my right leg muscles and would know if I had driven.
The reality is that the police do not have to prove that you were driving at the time of the alleged offence – and they are allowed by law to ask you to name the driver. If you do not know who was driving then you will be summonsed for failing to name the driver which carries 6 penalty points and a hefty fine.
You can defend this allegation if you can show that you have used reasonable diligence to work out who was driving at the time of the alleged offence. The police will ask you to prove that the people you have named are insured to drive and if they are not they will accuse you of permitting them to drive without insurance which carries 6-8 penalty points if convicted.
The photographic evidence simply has to identify the car and often does not contain identification evidence.
