Hi there, I have a mobile phone offence charge coming up. Before I pursue, I have many defences but your company does really apply to me.
In my charge, I can prove I was not on the phone at the relevant time. Must the officer take all details of the call logs like the number who I supposedly made the contact with and made sure my time on the phone matched his?
The officer is under a duty to fully investigate the case and look for evidence that points towards an offence and evidence that points away from an offence.
The officer has to prove his case beyond reasonable doubt to win.
