I have been given a fixed penalty notice, the officer has written the reg no. incorrect, ticked manual box on form when it is automatic and I did not surrender my licence and the officer has made no indication on form as to which police station I should take me licence to.
As there are mistakes should I fight the notice in court? Many thanks.
The ticket is not the officer’s evidence I’m afraid.
The only real question is whether or not the officer is able to prove beyond reasonable doubt that you were using the mobile whilst driving. You should take the ticket if you accept the offence.
If you deny using your phone whilst driving then the inaccuracies on the ticket may help you to cast a doubt on the reliability of his evidence.
