Question:

Speeding 83 in 70 (Mx motorway)

Your road traffic offence question: 1. Can the prosecution be enforced given the mobile talivan was parked on the hard shoulder of motorway? I understand that it’s illegal to park in the hard shoulder.

2. What will the likely penalty be if it is enforceable? My licence is currently clean and I’d like to keep it that way.

Yes I’m afraid they can park wherever they want and have a licence to ignore the rules that apply to the rest of us if they are on police business.

It would be perceived as sour grapes if you tried to defend the allegation on that basis. the court would simply state that they were only interested in whether or not you were speeding at the time alleged.

You are going to get 3 points and fixed penalty for this matter. Have you got any points already? If so, how many?
