My Car Was Not There

Question:

S.172 (2)(a) & (b) RTA 1988

The allegation was that my car was in x on x between 1500 & 1700 hours, but neither I nor the car was in x, nor ever has been. How do one refute the allegation, i.e. what steps do I take with the Police to prove the fact that the car was not there.

Have you been summonsed to court for failing to name the driver or have you just been sent a request to name the driver?

Was the car with you at the time of the alleged offence? Have you asked to see the photographic evidence to see whether or not its possible to show that its not your car? There maybe stickers in the window etc that may be able to distinguish your car.

How far is Sheffield from your home address? Is it possible that someone else could have taken the car?

Have you got any penalty points on your licence already? This offence carries 6 penalty points so you have to be careful. The police have to prove that its your car in that place at that time but if the court accept that it is your car you are at risk of a 6 points unless you can show that you have done your best to figure out who was driving at the time.
