Question:

Running a red light

We received a fine approx 7 days ago for this offence . Which was dated x

Also as I am the registered keeper they have my middle name wrong they have put D and it is P as you can image we were shocked as we couldn’t put down the driver so my partner put her self down as the driver on the day but really not sure. We both are named drivers.

Any advice would be gratefully received

I wouldn’t make too much of the misspelling. The issue is whether or not you can name the driver at the time.

Have you put on the letter that you are not sure who was driving at the time? The police will only accept that your partner was the driver if you have said categorically that it was.

If you are been hesitant in your nomination of your partner the police will not accept it and will threaten you with proceedings for failing to nominate the driver.

Have you got any points already? If so, how many?

I understand why the delay in getting the NIP and s.172 request to you would make it far more difficult to work out who was driving. Have you managed to figure out why it has taken so long for the police to get the request to you? Have they had trouble tracking you down?

Can you tell me more about why you are having trouble ascertaining who was driving? You may have a defence to failing to nominate if you have done your best.
