I’ve been served with 2 fixed penalty notices. The date on the letter is 14th of may, but the offences were dated 21st and 22nd April. I received the letter on 18th may. As the date of the offence was more than 14 days prior to the date the letter was issued, can I reject it?
You cannot reject the NIP, you still have to name the driver of the car even if the nip is defective. If you don’t you will be prosecuted for failing to name the driver which carries 6 points for each offence.
Are you the registered keeper of the car in question? Have you only just bought the car or have you moved recently?
The general rule is that a notice of intended prosecution has to be served on your within 14 days of the alleged offence but there are exceptions to the rule if the police have trouble tracking you down.
Have you got any points already? If so, how many?
