I had my dog traveling with me in my van. The vehicle is fitted with a parrot hands free system. A single police officer in standard patrol car has said he saw me move my hand away from my ear and he states he saw a mobile phone. The movement he saw was my dog.
I have now been summons for this and will need help to defend this action
If you were using a hands free kit at the time you have a defence. The officer has to prove beyond reasonable doubt that you were holding and using the phone at the time of the alleged offence. Therefore he has to make the court 90% or more sure that you were committed the offence. You only have to cast a reasonable doubt to be found not guilty.
You have to be careful in relation to the dog argument – because you don’t want the court to take the view that due to the presence of your dog you were not in proper control of the vehicle.
