I am pleading guilty to DRIVING OTHERWISE THAT IN ACCORDANCE WITH A PROVISIONAL DRIVING LICENCE AND NO INSURANCE, but would like the court to take into consideration these mitigation circumstances. I was misled by my insurance company as to the nature of the cover in place and this lead me to believe that I was insured at the time of driving the car.
My car insurance company cancelled the policy, failed to notify me of that in advance of the offence and provide documentary evidence in order to support my argument the car was only temporary cover.
The insurance company assumed that I knew this, I can confirm that I have been with the same car insurance for over two years. The supervisor driver confirmed to me that she had a full driving licence for over three years.
She passed her driving test x 2007. The L plates were placed on the car when I started driving and must have blown away because it was a windy day.

You are at risk of 6-8 points I’m afraid.
When you pass your test the penalty points will be on your new licence but you will still be able to drive. Be careful though because if you get anymore in the first two years your licence will be revoked under the new drivers act.
You need to explain to the court that you were unaware that you were not insured.
If you have a good argument come back to me and I will advise as to whether or not you can avoid the points by making a special reasons argument.
