The police officer stated I was using my mobile phone whilst driving. HE STATES HE SAW THE PHONE IN MY RIGHT HAND, AND I was typing.
1/ the phone was in the holder.
2/ I only touched it whilst stopped at the traffic light’s
3/ I have my phone records which show no calls made or received or texts sent during the time of the alleged offence.
Is it worth going to court to fight this summons.
There were two police officers in the vehicle. But they were behind my van, and not level with me. And there were another two cars between myself and the police car.
If they gang up against you then you will have a battle on your hands. Having said that they have to prove that you were using it beyond reasonable doubt; you only have to cast a doubt to win.
